1. Introduction
These Terms and Conditions (“Agreement”) constitute a legally binding contract between the Client (“you”, “your”) and Business Finder (“we”, “us”, “our”). By signing this Agreement or making payment for any membership plan, you acknowledge that you have read, understood, and agree to be bound by all terms set out herein.
2. Membership Plans and Fees
Business Finder offers two membership options:
- Monthly Plan — R400 per month, billed monthly on a month-to-month basis.
- Annual Plan — R4 000 per year, billed annually on a 12-month contract. This contract will automatically renew for successive 12-month periods unless cancelled in accordance with the cancellation policy set out in Section 8.
All fees are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. Business Finder reserves the right to revise membership fees upon providing the Client with no fewer than thirty (30) calendar days’ written notice prior to the effective date of any fee adjustment.
3. Payment Terms
All Electronic Fund Transfer (EFT) payments shall be received by Business Finder no later than the 7th day of each calendar month. Any payment not received by the due date shall be deemed a missed payment, and a penalty fee of fifteen percent (15%) of the outstanding amount will be levied. Should a debit-order collection fail for any reason, a penalty fee of fifteen percent (15%) of the missed payment amount will be charged. All costs and outstanding balances shall remain the responsibility of the individual who signs and accepts this Agreement.
4. Service Commencement
Services will commence immediately upon receipt of payment. For billing purposes, the service period will formally begin on the first (1st) day of the month following the initial payment. Online advertisements will be published within forty-eight (48) hours of service commencement. Google AdWords campaigns (where applicable) will become active within forty-eight (48) hours of service commencement.
5. Client Responsibilities
The Client shall provide all requested information, photographs, logos, and other materials necessary for the full delivery of the agreed services in a timely manner. The Client shall ensure that all information provided to Business Finder is true, accurate, complete, and not misleading. It is the Client’s sole responsibility to review and verify that all online advertisement content is correct and kept up to date.
6. Limitation of Liability
Business Finder shall not be held liable for any errors, omissions, or inaccuracies that appear on the website or in any advertising material, including but not limited to those arising from incorrect or incomplete information supplied by the Client. Business Finder makes no warranties, express or implied, regarding the performance or results of any advertising campaign.
7. Data Protection and Privacy
Business Finder is committed to the protection of personal and business information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). We will take all reasonable measures to ensure that any personal and business information in our possession is kept confidential and processed lawfully.
By engaging our services, you confirm that you are a duly authorised representative of the business listed herein and that you voluntarily consent to Business Finder collecting, processing, storing, and using the personal and business information provided for the purposes of fulfilling the obligations set out in this Agreement.
8. Cancellation Policy
This Agreement shall remain in force until formally cancelled in accordance with the provisions below. Only written cancellation notices will be accepted. Cancellation requests must be submitted no fewer than fifteen (15) calendar days before the end of the current billing month. If the Client cancels after entering into this Agreement but before payment has been received and services have been initiated, a cancellation fee of twenty percent (20%) of the applicable plan fee will be charged. No refund of any kind shall be issued once payment has been received and services have been initiated. For Annual Plan members, early termination within the 12-month term will not entitle the Client to a pro-rata refund of the annual fee.
9. General Provisions
This Agreement constitutes the entire agreement between the parties and supersedes any prior representations or agreements, whether written or oral. Business Finder reserves the right to amend these Terms and Conditions at any time, provided that the Client is given no fewer than thirty (30) calendar days’ written notice of any material changes. This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa.
